Himari Terms of Use

1. Acceptance of These Terms

By downloading, installing or using the Himari mobile application (the "App"), you agree to these Terms of Use. These Terms are an agreement between you and Codoha Ltd. ("Codoha"), a limited company registered in Taiwan (R.O.C.). If you do not agree, do not use the App.

2. License

The App is licensed to you, not sold. Codoha grants you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on Android devices that you own or control. This includes any in-app purchase you make.

3. The App

Himari is a Japanese kana course. It teaches hiragana and katakana through pictures, recorded audio and typed practice, and schedules your reviews for you. It works offline, requires no account, and keeps your progress on your device.

4. Purchases and Refunds

The hiragana course is free. The katakana course opens with a free first chapter, and the remaining chapters are unlocked by a single one-time in-app purchase. There is no subscription. All purchases are processed by Google Play™ under Google’s own terms, and your entitlement is held by your Google account, which is what lets you restore it on a new device. Refunds are handled by Google Play™ under Google’s refund policy, not by Codoha. Prices may change; a change never affects a purchase you have already made.

5. Your Progress

Your progress record stays on your device and is yours. You can export it at any time. Codoha has no access to it and no ability to review, back up or restore it. Uninstalling the App or clearing its data deletes it, and that cannot be undone by us. A purchase is not lost with it: your entitlement is held by Google, not by the record.

6. Intellectual Property

The App, including its artwork, characters, recordings, course content, design, code and branding, is owned by Codoha Ltd. and protected by applicable intellectual property laws. Except for the license above, no rights are granted to you. You may not extract, redistribute or reuse the App’s artwork, audio or course content.

7. App Stores

If you obtained the App from Google Play™, you acknowledge that Google is not a party to these Terms and is not responsible for the App or its content. These Terms are between you and Codoha only. Codoha, not the app store, is solely responsible for the App.

8. Disclaimer of Warranties

Your use of the App is at your sole risk. The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. The App is a learning aid; we do not warrant any particular learning outcome, nor that it will always be available, uninterrupted, secure or error-free. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you; in that case they apply to the fullest extent permitted by the law of your country of residence.

9. Limitation of Liability

To the maximum extent permitted by law, Codoha Ltd. and its affiliates, agents, directors, employees, suppliers and licensors shall not be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including loss of profits, goodwill, use or data, arising from your use of or inability to use the App. In no event shall Codoha Ltd.’s total liability exceed the amount you paid, if any, for the App, or USD 10, whichever is greater. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud, gross negligence or willful misconduct.

10. Changes to These Terms

Codoha may revise these Terms at any time. The current version will always be posted on this page. By continuing to use the App after changes take effect, you agree to the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of China (Taiwan), without regard to conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the Hualien District Court, Taiwan, for any disputes arising from these Terms or the App. If you are a consumer with your habitual residence in the European Union, the United Kingdom or another jurisdiction whose law grants you mandatory consumer protections, you additionally benefit from those mandatory provisions, and you may bring proceedings in the courts of your place of residence. Nothing in these Terms deprives you of your statutory rights as a consumer.
